Courts can issue directions to President

"Judges of Supreme Court and High Court already have authority to declare as unconstitutional, laws passed by State legislatures and Parliament. 

These Judges would also have the power to issue directions to constitutional authorities, such as the President and Governors to perform their public functions", said former Supreme Court judge Justice Jasti Chelameswar, in Chennai, on Saturday.

back door entry?

Federal government is trying to introduce the 3 farm laws through the back door in the Draft Federal Policy Framework on Agricultural Marketing, said Vijoo Krishnan, General Secretary, All India Kisan Sabha. 

Earlier, the three laws were repealed after protests by famers at New Delhi.

Unconstitutional behaviour

Stalin berated the Union minister for "cheating" Tamil Nadu by not releasing funds allocated for the State.

And asked pointedly, "Will you release the taxes collected from us or not? The funds belong to the students."

The school education minister Anbil Mahesh said,

Gujrati union minister named in subversion

Associated Press, OTTAWA  

A Canadian official on Tuesday alleged that Home Minister Amit Shah ordered a campaign of violence, intimidation and intelligence gathering, targeting Sikh separation  activists, in Canada. 

Deputy Foreign Affgairs Minister David Morrison told Parliament members of the national security committee that he had confirmed Mr. Shah's name to The Washington Post, which first reported the allegations.

"The journalist called me and asked if it was that person. I confirmed it was that person," Mr. Morrison told the committee. 

Mr. Morrison did not say how Canada knew of Mr. Shah's alleged involvement.

time for a new PM candidate

Something changed.  I cannot put a date to it. Something opened up. 

The election was transiting in phases; so was the public mood. 

The common refrain was, "chunav palat gaya hai"; the election has turned. 

This election was not contested by political parties, it was contested by the people. 

The BJP is likely to fall well short, of the majority mark of 272. 

In the context of the party's stranglehold over money, a servile media, spinelessness of institutions like the Election Commission, any number below 300 would be a defeat for the regime.

meri marzi . . . ?

Present leadership decided to replace 3 Rajya Sabha MPS and ordered to them, to resign - Swati Maliwal, Harbhajan Singh and Raghav Chadha. The three were conspicuous by their absence, when the leader was arrested and incarcerated.

Swati was in the US for months, Chadha stayed away in London and Harbhajan refrained from campaigning for the party in Punjab. The cricketer is accused of striking discordant notes, on political issues.

Alleged assault was unleashed on Swati, when she went to discuss the issue of her resignation from the Parliament. She said that the party was built by combined efforts of a lot of people. And all have earned the positions they have got. And refused to give up her seat. 

Harbhajan also has opposed the hukum to sack him. And tweeted that he cannot start canvassing without the party giving him a programme. 

Chadha has returned from London and met the present chief.

High time to change AAP leadership

chief minister passed on the mike to Sanjay Singh and refused to answer questions. 

If he is innocent in the matter, it screams for a response from him. Incident has happened in his residence, and involves his personal assistant. 

And there is a strong inference that it was done at his behest. And that inference gets stronger, with his continuing silence and his inaction.

Do you think that the personal secretary is going to misbehave with a Rajya Sabha member, who the chief minister has praised in the past - unless there is a tacit consent in this matter?   

AA Party now consists people who are a close cabal of criminals. .

Already there is a criminal case of money laundering, against the AA party. The party itself has been named as the accused. 

Birds of a feather flock together, and not one party member has stood up to condemn the assault. Their behaviour has now exposed them Clearly something terrible has happened. And it has happened in the chief minister's residence. The offences are serious, and some of them non bailable. Yet the chief minister, is silent.

. . . . . was angry with the Prime Minister P V Narasimha Rao when his government - in 1992 - decided to appeal against the  Delhi high court's decision, to quash a police complaint  in Bofors gun case, says senior party leader Margaret Alva. 

"What does the Prime Minister want to do? Send me to jail?", snapped the Congress President, when Alva met her. 

"What has the congress government done for me? This house was allotted to me by the Janata party's Chandrashekar government. I am not seeking any favors for myself or my children,  from him," she told the minister who was trying to patch peace.

"She was really angry," says Alva in her autobiography.

Even renamed Janata party ruled states are unhappy and oppose some clauses of FCA bill 2023

"The proposed amendment would grossly shrink the purpose and jurisdiction of the original Forest Conservation Act 1980, by removing restrictions on conservation of any Forest land," said Pradip Chatterjee  Convenor to the National Platform for Small Scale Fish  Workers.

federal govt. issues leave notice

Federal govt. has issued a 'leave  notice' to Satprem Maini , a long term resident of Auroville, and Director of Auroville Earth Institute.  

"I have given more than 34 years of my life to Auroville, which is my home. And India is my country. Yet I am thrown out like a piece of garbage," said Satprem in a WhatsApp message. 

Satprem released a technical evaluation report alleging that, the crown road laid by the Auroville Foundation, does not comply with the Indian Road Congress Codes. 

Satprem said that officials from FRRO, Chennai had told him that Auroville foundation secretary, had revoked the recommendation  for his stay at Auroville. 

A section of residents feel that revenge is being taken for exposing irregularities in the crown road project.

While going to the federal executive committee meeting in Goa, in 2002, he had made up his mind that the Gujarat government would be dismissed, if Narendra Modi refused to resign. 

But Vajpayee withheld his decision, because his Home Minister Lal Kishan Advani, threatened to resign from federal cabinet.

Autonomous States with common currency and defence umbrella?

Reorganization of States  on linguistic basis removed the Kannada, Malayalam and Telugu speaking regions from the Madras State. And Annadurai had to change the call for an independent Peninsular State to an independent Tamil State. 

Remaining in the Indian Union meant economic backwardness and linguistic subjugation.

But the China war brought changes to the Constitution. 

The sixteenth Amendment banned, parties with autonomy ideals, from contesting elections. Annadurai vehemently debated against this amendment in parliament, but could not stop it from being passed. 

And Annadurai worked at better cooperation between the Southern States.

Politicians push regional languages to extinction

Federal government should set right the disparity in allocation of funds to promote sanskrit and hindi, compared to other languages. Instead it is keen on imposition of hindi and sanskrit through Federal Education Policy. 

One of the official languages of the federation, is hindi; English is another. 

Linguists have pointed out that due to dominance of hindi, other languages like Maithili, Bhopuri, Santhali and Awadhi are on the verge of extinction.

Amendment violates Constitution?

The words socialist and secular were inserted in the Preamble of the Constitution under the 42nd Constitutional amendment moved by the Indira Nehru Khan's government in 1976. The amendment had changed the description of India - a sovereign, democratic republic

It is not possible for policy makers to  vary, alter or repeal the Preamble - it is not equivalent to an ordinary statute.

Also, the insertion is against the rights to freedom of religion, concept of judicial review. And so, it violates the Constitution. Only a limited amending power has been conferred on the Parliament.

Nominative local governance

Rajendra Prasad, President of Constituent Assembly of India, felt that elected representatives must be qualified with education.  

Work of a Legislative assembly is to frame and pass laws. Judges inquire points, pass judgements based on these laws. Lawyers argue cases based on these laws. And it is mandated that Judges and lawyers, be qualified by appropriate education, to perform these tasks. 

It is only fair, that people who pass laws are qualified, with a basic education, so they know the implications, positives and negatives of the laws they enact.

The federal governance's involvement goes beyond Defence, Railways, Post and Telegraph. 

In the name of being a "Welfare State", it creeps into all spheres of social life, and enacts laws. Such law makers will be better off, if they are educated enough to have working knowledge, of these processes. 

When Rajendra Prasad expressed these views, Nehru resisted. And felt that Prasad's observations can be taken to mean, that the Constituent Assembly not having confidence in his governance. Nehru threatened to resign. And succeeded in passing all his bills.

Experts flag disastrous move by apex green body

Standing committee of NBWL has recommended proposals for diversion of forest land. 

State advocate general and solicitor general - SG- of India, has expressed that extraction of natural gas and oil - including exploration and development -  is not a mining activity, citing Supreme Court's order dated August 2006. 

Experts have noted that the move would be disastrous, for environment and wildlife around national parks and sanctuaries. 

Environmental lawyer Dutta termed NBWL's recommendations as regressive. 

And cited the incident of massive environmental damage to Dibru- Saikhowa National Park and Maguri-Motapung Wetland, last year due to Baghjan gas leak.
